Accompaniment and representation of victims

The coming into force on November 30th 2021 of the Act to create a court specialized in sexual violence and domectic violence will bring important changes in the treatment of such files in court. The victim’s protection will be a central concern as soon as she makes contact with a police station. Our justice system adapts itself step by step to better answer the victims’ need for support.

I will endeavour to provide you with legal support to help you navigate through the various stages of a complaint process, and to complement other existing resources.

Sexual assault

The decision to report an assault is not an easy one. It may be relevant to know the options available to you and the implications that arise from each of them.

Also, the current state of our criminal law allows you to be represented by your own lawyer at certain stages of the proceedings. In those circumstances, a judge can order that the lawyer of your choice be funded by the state, regardless of your financial situation.

The justice system may seem complex and destabilizing. I can be at your side to enlighten and reassure you, particularly with regard to :

  • Decision to file a complaint
  • Rights and recourses based on the Canadian Victims Bill of Rights
  • Representation in front of the tribunal during debates concerning the use in evidence of elements of your privacy

Conjugal violence

Conjugal violence may take different forms, whether physical or psychological. Although coercive control is not yet a recognized offence under the Criminal Code, many behaviours are covered by existing offences.

In addition to the information you may receive from the police and other justice related professionals, I can advise you on a number of subjects, such as :

  • Decision to file a complaint
  • Rights and recourses based on the Canadian Victims Bill of Rights
  • Information about your rights and remedies in civil matters

Conjugal violence

The coming into force on November 30, 2021 of the Act to create a court specialized in sexual violence and domestic violence will bring a significant change in the trajectory of conjugal violence cases. The protection of the victim of conjugal violence will be a central concern starting at the first contact with a police service. Remember that conjugal violence can take many forms, from physical assault to emotional abuse.

While waiting for the new measures to be put in place, I can still advise you during several steps of the process, such as:

  • Decision to file a complaint
  • Preparation for meetings with the DPCP
  • Preparation for a testimony
  • Information about your rights and remedies in civil matters
